Terms & Conditions
General
In these conditions 'Company' means Evans Art Supplies Customer' means the individual, firm, company or other party with whom the Company contracts. 'Goods' mean the goods, articles and materials, which are to be supplied by the Company pursuant to the contract. 'Order' means a purchase order in respect of the goods issued by the Customer to the Company.
Prices
All prices quoted on this website are specific to evansartsupplies.ie and are Webstore prices only (these prices are not available in our retail store). The prices quoted are those valid at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down , including any alteration to the rate of value added tax. Where the price has been quoted by the Company for specific order quantities and specific delivery times, the Company reserves the right to vary the price for the Goods should the Customer require different quantities from those stated or require different delivery times.
Prices are inclusive of VAT.
While we accept One4All vouchers in our store we do not accept them on our website.
Items Out of Stock
From time to time there may be an error in our system allowing you to order an item which is out of stock. If this occurs we will contact you as soon as possible to discuss your options.
Product Information
We strive to provide the most accurate and up-to-date product information on our website. However, errors may occasionally occur. We reserve the right to correct any inaccuracies and are not responsible for any consequences resulting from incorrect or incomplete information. We recommend verifying product details before making a purchase.
We also do our best to display product colours as accurately as possible. However, colours may look different on your screen due to individual monitor settings.
Returns
If you find a product unsuitable and wish to return it for exchange or refund, please note the following:
- Goods returned must be in original packaging, with all original labels still attached.
- Goods must be returned within 14 days of receipt for web purchases and 28 days for store purchases.
- Goods be accompanied by receipt and note of reason for return.
- Any damaged or malfunctioning items must be highlighted to us within 7 days of receipt.
- Any other shortages/errors found regarding your order must also be highlighted to us within 7 days.
- Costs incurred in posting the returned item are not refundable, except in circumstances where the product is damaged or malfunctioning.
Please note there is no return on clearance items, Portfolios, Paper, Card, or Foamboards in-store and online.
For International Returns we can facilitate collection of your parcel for a cost of €10 + the original cost of shipping.
Order Cancellation
Orders may only be cancelled prior to processing. Once an order has been packed and processed, cancellations are no longer possible.
Please Note that delivery timeframes are estimates and not guaranteed. Delays in transit do not constitute grounds for order cancellation or refund.
Any orders shipped free of charge that are returned as a change of mind will incur the cost of the original shipping, which will be deducted from the total refund.
Delivery and Risk
Delivery of the Goods shall be made to the Customer at the place specified in the contract or as subsequently agreed between the parties and the risk in respect of the Goods shall pass to the Customer at the time of loading for dispatch to the Customer. Delivery dates are given in good faith and are adhered to as closely as possible, but no liability is accepted for any unforeseen delays subsequently arising or for any consequential loss or damage caused to the Customer or third parties as a result of any delays for whatever reason.
Force Majeure
The Company shall not be liable to the Customer, or be deemed to be in breach of contract with the Customer, by reason of any delay in performing, or any failure to perform any of the Company’s obligations in relation to the goods, if the delay or failure was due to force majeure or to any cause beyond the Company’s reasonable control.
Payment
Unless the contract otherwise provides, the contract price for the Goods shall be payable on placement of order. We accept Visa, Mastercard & Laser cards (not American Express). K&M Evans Gift vouchers are accepted both in store and on our website. Payments can also be processed through PayPal. One4All cards are only accepted in store.
Retention of Title
The Goods sold under these Terms and Conditions shall remain the absolute property of the Company and legal title in the goods shall remain vested in the Company until payment in full of all amounts invoiced or due to the Company in respect of the Goods has been received. If the Customer shall enter into liquidation, have a winding-up order made against it, have a receiver, administrator or administrative receiver appointed over its assets, income or any part thereof before the property in the Goods has passed in accordance with this condition, then the Company shall be entitled, immediately after giving notice of its intention to repossess the Goods, to enter upon the premises of the Customer to repossess any Goods to which it has title under this condition. No liquidator, receiver, administrator or administrative receiver of the Customer shall have authority to sell goods to which the Company has title without prior written consent of the Company.
Statutory Rights
These Terms and Conditions except the Customer's statutory rights are not affected.
Applicable Law
The Company only accepts orders and sells its Goods upon and subject to these Terms and Conditions which shall prevail over any terms or conditions of the Customer. These Terms and Conditions shall be governed by and construed in accordance with Irish Law and the parties acknowledge and accept the exclusive jurisdiction of the Irish Courts.
